Trust (Untouchable) Capital of Senator N.A. Butskovskiy as a Tool for Rehabilitation of Persons Prosecuted as a Result of Investigative and Judicial Error

 Based on published data, including statistical and financial data, the article considers the prerequisites for the creation, management and efficiency of the unique pre-revolutionary endowment of N.A. Butskovskiy. The life path and professional activity had a significant influence on N.A. Butskovskiy’s decision to bequeath his capital to charity. It is shown that the main purpose of the endowment was to overcome the social consequences of imperfections of the pre-revolutionary criminal procedure legislation, the achievement of which was seen by the founder of the “eternal endowment” in the material support of persons who were prosecuted as a result of investigative and judicial errors or a set of difficult life circumstances, as well as in the organisation of a shelter for needy participants of criminal proceedings on the part of the defence. The application of a set of financial indicators made it possible to trace the endowment capital value growth over the period from 1886 to 1916, to assess the efficiency of financial investments in securities, which ensured the issuance of cash benefits to an average of 12−13 needy people per year. The study shows that the management strategy of the Council of Chartered Attorneys at the St. Petersburg (later Petrograd) Court Chamber, who were not professional financiers, was aimed at obtaining a small but stable income, which made it possible to realize by 1916 a significant part of the charitable objectives set by the founder of the “perpetual endowment”. Despite its local character, the establishment of the endowment of Senator N.A. Butskovskiy was of great importance for the solution of acute social problems, as well as for the development of the institution of rehabilitation in the domestic criminal process.
